Terms of Service

MatchWorky is an information society service provided through the matchworky.pt web platform, within the meaning of Decree-Law No. 7/2004 of 7 January (Portuguese E-Commerce Law).

The platform is intended for companies and professionals who wish to structure recruitment interviews with AI support. Access by individuals as consumers is possible but is not the primary use case.

Any use that violates applicable Portuguese or European law is prohibited, including collecting data without a legal basis, distributing abusive or discriminatory content, or any activity that could harm candidates or third parties.

Each company account is responsible for managing admin access and credential security, in accordance with Art. 8 of Decree-Law No. 7/2004.

MatchWorky reserves the right to suspend or terminate accounts that violate these terms, with prior notice where possible, except in cases of serious or urgent breach.

Data collected during interviews belongs to the customer company that created the role. The customer is the data controller and must ensure GDPR compliance in the context of their recruitment process.

MatchWorky processes such data as a data processor, solely to provide the contracted features, with no parallel commercial use. A Data Processing Agreement (DPA) can be entered into upon request.

The software, design, brand, text, and all other elements of the platform are the property of MatchWorky or its licensors, protected under applicable copyright and intellectual property law.

A non-exclusive, non-transferable, revocable license is granted to the customer to access the platform during the active subscription period.

MatchWorky is not responsible for hiring decisions made by customer companies based on platform results. Final candidate evaluation is always the responsibility of the company's human decision-makers.

MatchWorky's liability for direct damages is limited to the amount paid by the customer in the 3 months preceding the event giving rise to the claim, except in cases of fraud or gross negligence.

We work to ensure high availability but do not assume specific SLA obligations unless agreed in writing. Occasional interruptions may occur for maintenance, updates, or security incident mitigation.

These Terms of Service are governed by Portuguese law. In the event of a dispute, the parties submit to the jurisdiction of the courts of Lisbon, without prejudice to mandatory consumer protection rules that cannot be waived by agreement.
